Please don't patronize me. I know Nick is not a saint. Nor do I think speaking against the use of his music in adverts implies that I am treating him like one.

Are you saying that we have to accept the zeitgeist? Advertisers can have what they want? Don't resist? Put up with it? Don't speak out?

Sorry, I didn't mean to patronize anyone. But if you read some of the post in this thread, you might think there's an attitude which seems to go in a direction which says "Don't touch this!". For me it's just beautiful music from a special guy.

I didn't say you have to accept anything; if you want to go on the barricades I'm not stopping you. But I'm more the guy that learns to live with it (or better ignore it).

Still wondering why there's no objection for using Nick's music for commercial movies... (oops, I'm teasing now, I guess)

I'm here in the States.
Are they actually playing this a lot over there (across the pond)?
The VW commercial (with Pink Moon) was awesome (for a commercial!) It was more of an ad for the song, you know?
Ok. Peace out!

A lot of people got into Nick thru the VW commercial
Hopefully some people get turned on thru this From the Morning. What can you do? one of my favorite Kinks songs (Picture book, from the Kinks are the Village Green Preservation Society) was used here in the States fairly recently for a commercial

The hope is that people get turned onto Nick thu the music for the cough syrup..

I mean, I'm assuming the guys who did this were fans of Nicks. I havent seen the commercial, unfortunately

I'm of 2 minds about this. Good if people get turned on, but Nicks music used in an ad for.. cough syrup? Why couldn't they use John Martyn?!

"You can discover the lover in thee
And I can discover the lover in you"

Though I don't think that would quite fit!

Well, even this forum has an advert.

 I assumed "PHP BB Creating Communities" was an advert.

I see! No, that's the software we use to power the forum and, as it's free to use, they leave their name on it. So I guess it is kind of an advert but certainly not a paid one.

:D

I have had an email from Cally in which he has said the estate "has limited powers to the use of Nick's music in non-traditional outlets"
He said he was hurt by my comments but I have clarified my outburst below.

Here is my reply...

Hello Cally,

If you note my orignal email it should be apparent that my comments are
dependent on the word "IF" . If you are telling me that you didn't directly
approve this then I have no beef with you or the estate.
Besides I am just a fan and no one of importance.
I never made a direct accusation. I confess ignorance but you are The Estate
and we do not know who else has control over the use of Nick's music.
"Now we rise and we are everywhere including Cough Syrup ads..."
Thanks for presumably putting me in the clear.
I still think that From The Morning has been abused.
Yours Sincerely

Stuart

I thought long and hard before posting this. I totally understand anyone disagreeing with the use of Nick's songs in adverts but I can understand why Cally would take offense at comments such as this directed at the estate

Anyone who has spoken to Cally knows that he takes the job of protecting Nick's legacy seriously and, while not everyone will agree with the course he chooses to take, he always acts with the best of intentions.

Cheers,

Matt

What's the problem? Nick's music and advertising is a win double!

In fact it's a triple whammy!

I listen to Pink Moon and From the Morning in a reliable, well-built, German engineered open-top car - and I hear every note because my head is cleared by a fast-acting nasal and sinus decongestant.

I'm a consumer and want to buy more stuff! Sell it to me, Nick!

The last song to be played in the car must be one from Monster Magnet, just when the car is hauled onto the junk pile

In this day and age there's very little chance the estate could have said no to this advert. Most record (and publishing) deals are set up to allow companies to pay 'blanket' licenses and use whatever music they like in ads. It's not necessarily right but is generally the way the business of music is conducted these days.
I'm not sure about this. Some artists are still able to refuse such offers: Sigur Ros were recently on telly saying that they'd turned down an estimated £2 million from advertisers because they were against their music being used to sell a product. If Nick's publishing deal means that the Estate isn't able to say how and where his music is used then they shouldn't have entered into said deal in the first place. It leaves me wondering exactly what powers they do have.
